1. Using the Open Crealearning Service

The Open Crealearning Service is available at the following web address: https://open.crea-learning.com; use of this website constitutes your approval and acceptance of the following Terms and Conditions of Use.

2. Acceptance of Terms and Conditions

2.1 The use of the Open CreaLearning Service involves the acceptance of all the Terms and Conditions. If you do not accept them you cannot use the Service.

2.2. To use the Open CreaLearning Service and accept the T&C’s you must be over 18 and respect local legislation if you are an international user.

2.3 Logipro keeps the right to modify these T&Cs at any time so as the data protection provisions for future transactions. Modifications to these T&Cs come into force at the same time for all Users, who are required to inform themselves of these modifications.

You explicitly accept that you are sole responsible for all activity connected to your Open CreaLearning account and data protection.

Should an unauthorised third party use your account you must notify Open CreaLearning immediately at the following address: contact@crea-learning.com

3. Description of Service

Open CreaLearning is a SCORM-compliant creation tool. It can be used to present, view, create and narrate various resources: texts, images, videos, quizzes… All of CreaLearning’s productions are SCORM 1.2 – compliant and can be reused in any LMS tool that supports SCORM. The option “share a SCORM creation to a LMS tool” is not available on the free version.

CreaLearning productions can then be shared, transmitted and viewed from a HTML link which can be sent through social networks, e-mails and like.

4. Obligations and restrictions

- You agree not to upload, transmit, post, e-mail nor make available in any other way any unauthorised, illegal contents through Open Crea creations.Racist, hateful or in any way reprehensible remarks are forbidden.

- You agree not to use Open CreaLearning to harm others

- You agree not to upload, transmit, post, e-mail or otherwise make available, any material or content which infringes copyright, corporate branding, private life or any other third party rights. You must comply with all intellectual property rights and applicable legislation to use the Service.

- You agree not to connote affiliation or endorsement from Open CreaLearning for your content or the presentation creator.

- You agree not to copy, reproduce, transmit, diffuse, pass on, post, sell or give away licences or use contents for any other purpose without prior written consent from Open CreaLearning.

5. Copyright

In accordance with copyright and intellectual property policy, Open CreaLearning will terminate a user’s access to the Service, in the case of violation of intellectual property or copyright. The editor of the company in question will decide if copyright has been violated.

You expressly agree and accept that Open CreaLearning can, at their own discretion and without prior warning, close your account and access to the Service and/or block future access to the Service and no fee paid will be refunded. Open CreaLearning’s policy is to close all user accounts which repeatedly infringe third party intellectual property rights.

6. Data base indexing

Open CreaLearning grants public search engines authorisation to use spiders to copy data from the site solely to create a database index available to the public and not to create caches or to archive the data. Open CreaLearning reserves the right to revoke these exceptions in specific cases or in a general manner.

7. Development and changes in the Service

Open CreaLearning are constantly innovating in order to provide the best quality Service to their users. You accept that the form, design and nature of the Service offered by Open CreaLearning can be modified without prior notice.

You accept, as part of this constant innovation, that CreaLearning may (permanently or temporarily) no longer offer you, or users in general, the Service (or any feature or characteristic which is part of the Service) at their discretion and without prior notice.

8. Opening an account

You must create and open an account to use the Open CreaLearning Service. Use the corresponding inscription form to open an account free of charge.

Open CreaLearning offer both free of charge and fee-paying Services.

Open CreaLearning (free of charge)
If you have an Open CreaLearning account (free), all content that you create, including information contained in your presentation, will be available for anyone to access on internet ("Public User Content»). Your creations will be public and can be seen by other Open CreaLearning users and searchable in the Open CreaLearning public database. They will be available for others to access and view online. You are therefore granting each user and the general public a global licence which is both non-exclusive and non-revocable and allows public access and viewing of your creation. This licence expires when you delete your presentation, you switch to a fee-paying account or your account is deleted (by you or by us).

Open CreaLearning (fee-paying Services)
If you are using the Open CreaLearning fee-paying option, you can choose if you want your content to be public or private. Created content that you chose to make private will not be available in the Open CreaLearning database. You can also control access by password which can be set up in the creation description. You can invite one or more people to post your presentation by sending them a “part" link. Learn more about sharing here. You are granting each spectator that you have invited a global licence which is both non-exclusive and non-revocable and allows public access and viewing of your creation. This licence expires when you delete your presentation or your account is deleted (by you or by us).

9. Sharing content created

The creations on the free of charge version are accessible via public HTML link and will be shared with the Open CreaLearning community. You agree and accept that Open CreaLearning does not guarantee content confidentiality whether the content is transmitted or not.

You expressly agree and accept that you are solely responsible for your own content and the consequences of their diffusion. Open CreaLearning neither supports nor endorses content, opinions, recommendations or points of view expressed in the contents. Open CreaLearning hereby declines all responsibility for content.

You hereby declare and guarantee that you have (and will continue to have so throughout the duration of your use of the Service) all necessary rights, licences, authorisations and consents for Open CreaLearning to use your contents to offer its Service and more generally in accordance with these T&C’s.

If you change option, your creations will be subject to the conditions valid at the time they were diffused.

With Open CreaLearning you can add third party content, such as images, videos, sound, to your creation. Such third party content is subject to certain license terms. . Some license terms may limit the manner in which you are permitted to share content with others or to allow re-use of a presentation. You agree to review and comply with the license terms applicable to any third party content in a creation.

Creations may contain hyperlinks to other websites that do not belong to, or are not controlled by, Open CreaLearning. Open CreaLearning has no control over content, personal data protection charters or any third party site practices and declines all responsibility in this matter.

10. Payment Terms

By choosing the fee-paying option, you are accepting to pay the current fee for the account type you have selected (for example Premium or Pro). If you started with a free account, the current fee for the account type you have selected will automatically and immediately be charged. If you did not open your account with a free version the current fee for the account type you have selected will automatically and immediately be charged. The fee payment is non- refundable. If you cancel your reoccurring subscription your account will remain active until the next renewal date. If you cancel your account before the end of a pre-paid period your cancellation will be take effect immediately. In both cases (cancellation or deletion), you will not be given a refund.

11. Disclaimer guarantees

You understand and agree that your use of the Open CreaLearning Service is your sole responsibility. The Service is provided on as “as is” basis. Open CreaLearning expressly disclaim all guarantees of any kind, including, but not limited to, workability and quality guarantees and fitness for a particular service.
In other words, Open CreaLearning does not guarantee the following:
- That the Service meets your requirements;
- That the Service will be uninterrupted, fast, safe or errorless;
- That information obtained through the Service is exact;
- That the content creation will be hosted and / or distributed without interruption;
- That the product will meet your needs or any other quality norm;
- That any operating defects in the Service will be corrected.

Open CreaLearning will not be liable to you for any direct or indirect damages that may be incurred as a result of you using the Service. This includes, but is not limited to, loss off profit, reputation, clientele or data.

This includes any damages incurred as a result of: - Any changes that Open CreaLearning make to the Service;
- Any permanent or temporary cessation of the Service;
- Deletion or absence of stored content or data;
- Your failure to keep your password or account details secure.

To the extent permitted by law, the total liability of Open CreaLearning, for any claim under these terms and conditions, including for any implied guarantees, is limited to the amount you paid to us for use of the Services.

Under no circumstances will Open CreaLearning be held responsible for the content of creations.

12. Indemnification

You agree to indemnify Open CreaLearning from any and all liabilities and costs (including reasonable legal fees) incurred by Open CreaLearning in connection with any claim arising out of your breach of these Terms and Conditions. Open CreaLearning reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you.

13. Termination

13.1 These terms and conditions will continue to apply until termination by either you or Open CreaLearning under the following conditions:

13.2 If you wish to terminate your contract with Open CreaLearning, you can do so by notifying Open CreaLearning directly or by closing your Open CreaLearning account.

13.3 Open CreaLearning can terminate your account at any time if:
- you have violated the terms and conditions of this agreement (or if you act in a way which clearly demonstrates that you have no intention of, or are unable to respect the present terms and conditions.);
- Open CreaLearning is legally obliged to do so (for example, if providing you this Service becomes illegal);
- Open CreaLearning no longer provides the Service to users in your place of residence or the country from which you are accessing the Service;
- the Service that Open CreaLearning is providing is no longer financially viable in, Open CreaLearning’s opinion.

14. User experience analysis

We use Hotjar to understand better the needs of our users and to optimize Créa Learning’s experience.
Hotjar is a technological service which helps us to better understand users’ experience (for example which features they prefer, what users do not like, etc.) and this allows us to evolve our software with user’s feedback.

Hotjar uses cookies and other technologies to collect data on the behavior of our users and their devices (in particular the IP address of the device captured and stored only in anonymous form, the screen size of the device, device type (unique identifiers), browser information, geographic location (country only), preferred language used to display our website).
